Probate
Probate is the legal process by which the court distributes the decedent's assets after they pass away. The Dabney-Norman Law Firm works closely with our client's and their families to help them minimize the assets that must be probated. The probate rules are complex, so we offer our guidance and expertise to help family members and executors of the estate get through the process.
The probate process: Step 1
The executor or executrix named in the will must file an application for probate in the county where the decedent lived. The court will post notice of the application for probate as legally required to give notice to anyone who desires to contest the will.

The probate process: Step 2
If no one contests the will, the court will determine if there was a will and if the will is valid by holding a hearing. The court will appoint the executor or executrix designated in the will. If there is no will and the decedent dies intestate, the judge will appoint and administrator of the estate.

The probate process: Step 3
The executor, executrix, or the administrator will locate the estate assets, identify the beneficiaries, notify creditors, and mediate all disputes between the beneficiaries and and creditors, if any.
